    A kayaker found himself under gunfire in Galveston, after a confrontation with a shrimp boat captain

                Assuming he did not see the trawler and didn't paddle to get in his way.
                The kayak isn't a commercial fishing vessel so isn't competing with the trawler.

                  The dude in the kayak got upset because the shrimper was running over his lines he set out. He paddles out there, they get an argument and he pulls a knife to cut the shrimpers lines. The shrimper warns him and pulls out a gun and fires in front of 20 witnesses on the 61st pier, then calls the game warden who comes out and arrest him for deadly conduct.

                  Hauls him into to Baytown. Heard the guy had 900lbs of huge shrimp that only run a few days a year in that close up gut. So the shrimper looses his catch and the opportunity to shrimp the next few days while they're running thru.

                  Consider this, if a guy pulls up beside you and shoots the tires out of your trailor your pulling down 3005 because you accidentally cut him off, ( both have the R-O-W like the kayaker and shrimper), do you have the right to protect your property?

                    Found out just what JT said. I also know who it was but that's irrelevant. The shrimper is the one that called the authorities and he's also the one that got arrested. There's fault on both sides. An unfortunate situation all around.

                      Although a cooler head should've prevailed, my sympathy is with the shrimper. I'd be surprised if it's not dropped. That old saying "you can beat the rap but not the ride".

                      Poor guy lost his catch and probably the opportunity to shrimp while they're in close. PLUS he now gets to waste about 5k on some a-hole lawyer to defend him.

                              The shrimper is way out of line discharging a firearm in the general area of a person . Idiot move because he can't control his anger . His financial loss is entirely his fault .
