I had a customer that has a big boat that had a lot of work done, ran up a large bill, waited 2 weeks for payment, had to threaten storage fee's to get his bill paid, even dropped it off for him @ his marina. He pays with AMEX over the phone, comes to my office on the 15th (5days after we drop it off), says he's having issue and I wasn't here I was at lunch. Makes threats to my employees he is going to send his boys down to stake out the place until I show up and fix his problem. I come in 2-3 minutes after he had left, watch it all on DVR and hear all about it from my employee's. I call him, tell him to meet me at the marina, he agrees, then I get there about 15-20 min later and I call him and he says he has a meeting and just to fix it. I find out he has a unrelated issue with fuel tank and was not part of our scope or ever charged for the repairs. I order the parts, go the next day and take 3 additional techs with me to have everything looked over just in case. We fix and video Test run the boat for 30-45 minutes, call customer during test, send him video of his motors running all RPM ranges, and 4min. @6250RPM's on both motors, he calls when we are docking at his marina and after watching video. He expresses his gratitude to me and my crew. Yesterday the 20th I get a email from my CC processing company saying he has charged back his payment and they had already taken it from our bank. They also informed me that all my other in batch transactions, and any further transactions will be halted until this dispute is settled. So not only do I have all the funds from his transaction sucked out of my bank account, all my other money I am expecting to be deposited into my account is held in a reserve account that I cant access and solely at the discretion of CC processor. I said how long will this take. 4-8 Weeks typically. So I have very great documentation via email estimates approved by customer, photos / videos of before, during, and after progress and even final after the out of scope work performed. I am filing a lawsuit this morning, felony theft of service charges, and need an attorney to fight this for me. Time is of the essence, Let say with his money they took out, the funds I had batched from other customer transactions and the final bill that I think pushed this to happen, i'm out of pocket in the neighborhood of 12K +. Being a small business its hard to have hits like this, and for 4-8 weeks it will hurt bad. I have customers that have ordered power poles, and other products that I have to come out of pocket personaly and pay until this issue gets resolved, its not the customers fault they gave me a deposit to order, and this has all the money tied up with my processor until this is resolved which makes no sense at all because they already took the disputed money out of my bank!!! . The other huge thing is I cant receive money from CC's right now, I can charge all the money I want to CC's, but wont be released until this is resolved. I want this Scum to pay for what he has done to me, customers, family, and employee's!!!! I cant stand for someone to blattenly do this with out even calling me if he did have a problem. I always have been a stand behind my work guy and anyone here that has dealt with me knows this. Everything I have read is that without him calling and trying to resolve an issue and just doing a charge back without trying resolve and notifying the merchant, it is fraud. I know it is fraud to pay services then cancel or charge back the CC. SOmeone please help me out with this, I would be very grateful!!!!
