  • Fencing Kayak/wade access on Bob Smith in JB

    Looks like "they" are going to fence off the kayak/wade access on Bob Smith in JB. The bob wire fence runs all the way down to the bay. A few years ago I spoke with the TGLO and they said that was public access. Also, how are they allowed to fence off that restoration area further down Bob Smith?

    Have you checked the GalvestonCad.org records/Tax rolls? I don't believe that the land west of Jam Beach is GLO/State Lands. The fence existed for many many years-cattle grazing-I believe Ike took out the fence.

      I checked the Tax Rolls-it is privately owned land by a family in Waller. tract is 99+ acres along Bob Smith Road and is ag exemption (which fits what I said above).

        The land immediately adjacent and west of Bob Smith, all the way to the end of the road, is privately owned. I checked Galveston CAD (R117139).

            Fencing Kayak/wade access on Bob Smith in JB

            Not too long ago they did not care about the fishermen stepping through the fence. However this morphed into people cutting the wire and they stated having to chase lost cattle. This forced them to post it as no trespassing which was ignored by everyone. After Ike took more of the fence down people started driving their cars and golf carts out there.

              yes, I had checked the tax roles and knew it is privately owned. However, the lady at the TGLO told me that the restoration projects and the sand flats are TGLO land. It's been a few years back but the TGLO office told me that that was public bay access, by the sand flats. I've cut the fence before when they tried to fence across the bayou in the back of jumbile. TGLO said that was fine.

                I would not cut anyone's fence-period. The GLO is not a court of law and there are numerous cases about subsidence and whether property is State or Private (See Severance V. State of Texas for the latest case-many other cases exist such as King Ranch and LLM lands in dispute).

                The GLO has no right to tell you to trespass and I am certain the person you spoke with was not understanding that you crossed above the mean tide mark to get to the "flats"-try that on the King ranch and see what happens when you walk on their sand flats-they will arrest you for trespassing! You cannot cross private property to get to the bay-period-unless the property owner gives you permission

                Cutting fences and driving vehicles is why they fenced it-the cows have been gone a long time and yes, the owners may have been kind enough to allow trespass for those that respected the land (didn't trash it and left as it was), but because someone farges it up, no one gets use.

                  Further, that "bayou" is likely not a Navigable River, Stream or Bayou, so yes they can fence across it. Go down to Port O and head west down the ICW-some of those cuts are fenced.

                    just telling you what the TGLO told me. And no, I didn't cut any fences to drive my car through. I cut a fence to drive my boat through. btw that was 3 years ago and I can still drive my boat through it.

                      I aint picking on ya-and sounds "navigable", but so were places by Maggies that had fences in there-I thinks the land subsided!???

                      I've noticed the fence over by Spanish Grant Subdivision (you can see the fence south of Stewart Rd) and those fences go across the lake/bay's in there and wondered about them.

                        I'm kinda glad to see a fence to tell the truth. I've watched people drive, doing donutd and get stuck all through there. I've picked up their trash and extinguished their camp fires. I've picked up about a dozen PVC rod holders from what people left for "next time"...my consolation I guess.

                          Same kinda crapola happened around Starvation and messed it up for folks. Just sux that poeple trash places-sure be great to trash their place and see how they like it.

                              They're just getting around to fencing the property. I figured that was what was happening when they piled up the old wire & posts and mowed the fence line. Since Ike you have been able to walk-in there and a lot of folks have been enjoying that privilege, but people were driving in so first they put up posts, and people recently started driving around them too.
                              The general public are just really trashy & stupid......how do you think we got the current president?
