Yep, the Texas Constitution prohibits Texas public money from being spent on private property. By law, no town, county, or state agency should be cleaning the beach on West End beaches, including trash removal. When that beach was under the Open Beaches Act, it was a public right of way. Now the West End is not. Jerry Patterson at the GLO knows this, and I think Galveston is coming to grips with it. Technically, you can't even fish on the beach unless you are wading in the water.
If anyone tries that stunt like what Carol Severance did on the West End beaches, anywhere else on the Texas coast, I say it's time for a rebellion. I'll be glad to join that little tea party for sure.
