  • Attention Jamaica Beach Property Owners

    The JB city council has two proposed ordinances they are contemplating passing and we need you at the Council meeting next Monday, April 18th. at 6:00 PM.

    I. One would make the public bulkhead on Flamingo Way along the main canal a public park. The property in question has been public since 1962 without permits or restrictions. The city wants to restrict fishing & crabbing and issue permit$ to non-residents and certain non specified "requirements" for property owners to fish & crab.
    This is being pushed by two old busybodies on Flamingo Way and an adjoining street that don't like people using the city right-of-way. It bothers them, particularly if you're not white!
    2. an ordinance to prohibit the parking of certain vehicles on your property including RV's, trailers, recreational vehicles, boats and boat trailers.
    It's not a coincidence that the same to old busybodies are behind this as well.

            1. if you live on a canal, you own the water in front of you.

            2. if you live on the beach, you own the sand to the water in front of you.

            3. if youre an old biddy-pita and have live in a s/d for a few years, you are entitled to ***** about things you dont like.

              They live in a beach/bay development and they want to prohibit boats and boat trailers???????????? I would be absolutely PIZZED!!!!!!

                  I hope you get a good turn out. I fear that the lack of attendance might work in favor for these two guys. Do they publish the agenda in the local newspaper? This would make a good story for channel 2 news. No boats allowed in a beach community homes? Wth, guess they think they own the area.

                    The laffites cove HOA has the same boat/rv ordinance. You can have your boat in the driveway as long as it fits in a overhanging open garage space.

                    Thats what i hate about these developments.... only 2-3% (if that) actually live there full time and hold hoa meetings on tuesday around dinner time (330pm for them). Im sure theres a nice procession of rascle motorized wheelchairs to the event sponsored by the scooter store.

                    These people actually fine you for leaving a boat that is too big to fit in the covered parking spots.

                    They should be more worried about me running over the spoiled 14 y/o kids in $10k golf carts

                      Jamaica Beach sure isn't Laffite's Cove, but people sure want it to be. Bunch of "planned community" Houston people coming down to the beach and wanting the same kind of uptight, fenced, gated, gilded ghetto restrictions they left to get away from.
                      BTW I'd guess more than half the people in JB are full time.

                        There is a Petition circulating about the "trailer issue". I sent the below email to the city admimn asking that it be forwarded to the Mayor and Council. Meeting is the 18th. I of course will be at work and cannot attend, plus Mona's medical issues.

                        I suggest you copy and paste the below email and attend the 4/18 meeting-I believe it will be packed and maybe a riot will ensue.:

                        Gentlemen/Ladies:

                        I understand that the Mayor and Council are proposing/considering a new Ordinance which affects the ability of property owners to have boat trailers parked behind the Set Back Lines.

                        The Deed Restrictions already provide rules and regulations regarding placement of boat trailers and I believe you cannot legally attempt to usurp the rights, terms, conditions and provisions of the Deed Restrictions without the approval of the “Owners”, as same is defined in the Covenant of Deed Restrictions. Being able to park my boat trailer LEGALLY upon my property was part of the consideration of my acquisition of my property.

                        Further, by denying the right of Owners to park their boat trailers behind the Set Back Lines, you will diminish property values, since potential purchasers will realize they must find a boat storage facility which may be many miles away; thereby causing additional costs (as well as inconvenience and time) and will make living in other subdivisions within the Island of Galveston much more attractive than choosing to live in the City of Jamaica Beach. It appears that this point has not been considered by the proponents of the new Ordinance. With lower tax revenues already occurring due to the depressed economy and market, you effectively will cause even lower property values due to even lower sales and little incentive for people to move to or live in Jamaica Beach. Certainly the financial affect alone is reason enough not to pass or even consider such an Ordinance since it will negatively affect the tax base which the City depends upon to survive. Additionally, please take into consideration the cost of legal defense that will be needed to attempt to sustain such an Ordinance. The City will be facing attorney fees for defense and also may be burdened with paying the Plaintiffs’ Attorneys’ fees should it lose. Because there are multiple versions of Deed Restrictions, there will likely be multiple lawsuits filed under each version by Owners to protect their existing property rights to park boat trailers behind the Set Back Lines. I have spoken to several of my neighbors and they are in agreement with me and also believe the City should not usurp the Deed Restrictions by outlawing the parking of boat trailers as presently allowed via the Deed Restrictions. My neighbors also indicated a willingness to join together in obtaining legal counsel to protect their rights as Owners against unlawful ordinances that are contrary to the terms, provisions and conditions of the Covenant of Deed Restrictions applicable to the various Sections within the confines of City of Jamaica Beach. The Owners’ legal cost of challenging the Ordinance, if passed, shall be less than the overall cost of finding boat and boat trailer storage facilities and the associated incremental costs of travel to and from such storage facility; therefore, it is a simple decision to hire legal counsel to challenge the Ordinance if passed.

                        Please consider this an objection to Ordinance 2011 as being proposed in regards to changing the ability to park boat trailers behind the Set Back Line as currently allowed under the Deed Restrictions.

                        It appears to me, that this Council has forgotten that this City is based on recreation in the surrounding water and any action to eradicate the rights of the Owners to park their boat trailers legally upon their property is an absurdity, unless the City will provide free, safe and secure storage facilities for the hundreds of boat trailers located within the City-that notion/proposal is as ridiculous as the attempted passage of such an Ordinance, especially in the dire financial times we face today.

                        I hope that you come to see the fallacy of such a proposed ordinance and cease and desist in its attempted passage.

                          Who are the "usual suspects?" Not names, but are they people that recently moved in and want to "beautify" the area by ridding the driveways of ghastly vehicles/boats/trailers? I couldn't imagine that JB old-schoolers would want to change the current ordinance??

                          Maybe they have a plan to buy some land next to JB and build covered boat storage for your convenience and of course, at a slight discount!

                            No, it's a few folks (like anyplace USA), that are busybodies. The main point/complaint they have about the use of the area Kenny mentioned is the trash they leave. Think about it, if you lived by that area and see some people that sit and fish, leave trash and are yourself elderly, you wonder if they are scumbags and will rob and steal from you. I see their point to a degree, but there are No Parking signs that keep them out at night (7 pm to 7 am). My parents lived near that area and my mother did not like those folks there-her point was they:

                            1. Looked like trash usually (low income folks that do not live there).
                            2. Leave trash in the area.
                            3. Have a tendency to keep throwbacks in their bucket.
                            4. Have ample opportunity to "wander" over to a close by residence and "help themselves" to some items laying around downstairs.


                            My issue is not the use of that area-heck, I have to motor away so I don't catch theoir lines in my prop and sometimes have some idiot heading at me because I had to move to stay away from their lines and as you know, many idiots are in boats and not paying attention. My issue is the boat trailers-the City says it "means" RV's and the like and not Boat Trailers-well if that's true, change the GD proposed ordinance to clarify that; otherwise, expect many lawsuits against the city.
